In 2009 the European Commission proposed to modify the EU Road Transport Working Time Directive (2002/15/EC) to permanently exclude self-employed drivers to help bring ¡®false¡¯ self-employed drivers within its scope. This ·¬ÇÑÊÓÆµPosition advocates the exclusion of the self-employed drivers from the Working Time Directive and addresses issues such as the current negative definition of ¡®self-employed¡¯ drivers that hinders the identification of fake self-employed drivers, removing impracticalities related night work rules, and improving enforcement of these rules by Member States.
